Eliana Alcivar is a Partner in the Technology and Data Privacy practice group at Baer Crossey McDemus. Eliana focuses her practice on providing advocacy and counsel to companies of all sizes and in all stages of their life cycle with technology, contracting, privacy, and intellectual property law matters. Eliana drafts, negotiates, and provides strategic structuring counseling in connection with technology vendor agreements, SaaS agreements, hardware and software purchase and licensing agreements, reseller and authorized dealer agreements, online advertising/affiliate marketing agreements, software and hardware warranty and support agreements, white label/OEM supply agreements, technology services consulting and employment agreements, and privacy policies and terms of use, and has provided extensive counsel in the area of open source software licensing and compliance. She is also available to provide counsel in the areas of sales tax compliance, state government procurement matters, student data privacy law compliance, and drafting and negotiating media/content license agreements.

Eliana previously worked for Baer Crossey McDemus as an Associate, before leaving to serve as in-house counsel for a prominent EdTech company delivering a sophisticated software and hardware system to K-12 public and private schools across the United States. Eliana began her legal career in the litigation department of the Philadelphia office of Ballard Spahr, where she served as a General Litigation associate as well as a member of the White Collar Defense practice group and represented clients in a variety of litigation and regulatory investigative matters. A long-time technology enthusiast, she also worked for several years leading teams of designers, programmers, writers, multimedia professionals, and faculty in the design of award-winning online college courses.

Eliana earned her J.D. from the University of Pennsylvania Law School, where she served as Articles Editor for the Journal of Labor and Employment Law. She earned her B.A. from the State University of New York – College at Fredonia, where she majored in Philosophy and Legal Studies.

Eliana is admitted to practice law in Pennsylvania and is a member of the Hispanic Bar Association of Pennsylvania.
